cation. This is especially true for Art. 139, which allowed exceptional restrictions on the fundamental rights of former Nazis in the immediate post-war period. In turn, such restrictions are not already covered by Art. 21 § 2 or other militant democracy provisions. This more cautious approach of interpreting militant democracy rules is supported by the great importance of political freedom in the case law of the German Constitutional Court regarding, e. g. freedom of speech and proportionality. It follows that the prevention of a dissemination of extremist views is not (or at least no longer) a legitimate aim of state power. Party proscription therefore will only satisfy the requirements of Art. 21 § 2, if the party in question poses an imminent threat to the free democratic basic order.
