Public international law has lost its contours in a process of fragmentation into a plurality of different subjects and matters. Is constitutionalism the concept that might be able to do justice to the transformation of classical state centred public international law under conditions of globalisation and open a perspective on a structure to come? This assumption collides already with the paradoxical phenomenon of a constitutionalisation of the law in general which can be observed in countries like Germany. Also in retrospect the conditions of a re-entry of the older concept of constitution in the emerging world society cannot be taken for granted. Public international law can only strive for order far from equilibrium. The network concept offers more differentiation and more reflexivity for a perspective on the evolution of a legal order beyond the state.
