Summary
The article discusses the influence of the pictorial and iconic turn on the interpretation and reconstruction of certain provisions in European Copyright Directives and German Copyright Laws regarding citations, archival uses and social media practices, such as »instagramming« and the publication of selfies on social media platforms. While the reproducibility of art in the 20th century is said to have destroyed the aura of art as something unique (Walter Benjamin), digitization has a huge impact on communicating in the 21st century. People communicate by pictures and not only by texts in ways not envisaged at the time of enactment of current copyright legislation. Showing, archiving and illustrating are therefore cultural techniques which participate in the freedom of expression and artistic and scientific freedoms protected by constitutional privileges. Copyright limitations should be open for these communicative changes. Wenn die Reproduzierbarkeit des Kunstwerkes nach Walter Benjamin die Aura des Einmaligen gefährdet, wie wirkt sich dann der Einsatz von Bildern in vernetzten Kommunikationen aus? Der Beitrag geht dieser Frage und den aus ihrer Beantwortung folgenden Antworten auf die Ausgestaltung der urheberrechtlichen Schrankenbestimmungen nach.
