Summary
In S.C./Brazil, the Committee on the Rights of Persons with disabilities dismissed an individual complaint for non-exhaustion of local remedies in a case where the author had not been able to obtain legal aid for a domestic remedy. The case raises difficult questions of ex officio scrutiny, the right to be heard, burden of proof, and effectiveness of local remedies, which the Committee fails to address. Apparently, the Committee, which is an expert body for issues concerning disabilities and the rights of persons with disabilities, is not qualified to address complex issues of procedural law.
