Der Beitrag ökonomischer Forschung zum Urheberrecht Bestandsaufnahme und interdisziplinäre Ideenskizze

Growing importance has been attached to the economic analysis of intellectual property law in more recent German research. The paper examines the possibilities and limits of economic research on copyright law. Recent approaches, such as game theory, behavioural and experimental economics are comprised in the analysis. This broad foundation allows to thoroughly explore the possible contribution of economic arguments to the general justification of copyright protection, as well as to identify the inevitable limitations of economic analysis where the reasonable balancing of interests in copyright law is concerned. In particular, compared to economic research on patent law issues, empirical data on copyright issues are still rare. In this context, the paper suggests specific fields and methods for further empirical studies. Moreover, constitutional and other normative values have to be included in the analysis in order to develop a realistic economic model of copyright law (normative economic analysis). At the same time, constitutional rights set certain necessary limits even to the normative economic analysis of copyright law. Given the fact that for these and other methodological reasons economic analysis is not able to propose clear-cut solutions to the »big« questions, concerning the reasonable conditions, scope and limitations of copyright protection, the paper suggests that further economic research should also be directed at the appropriate mechanisms to achieve balanced solutions in a situation of informational uncertainty. In particular, the function of rules and standards in copyright law is analysed. This should be subject to further institutional, empirical and psychological research in particular in the field of limitations to copyright protection. Thus, economic research can contribute to the design of an adequate legislative framework which leaves the necessary leeway for manoeuvre to case law solutions in this and other areas. Apart from the implied methodological questions, the paper maps out further specific fields where economic research is necessary and promising, such as principal-agent analysis of the copyright exploitation chain in different markets, the discussions on open access to academic research results in Germany as well as a further differentiation of the incentive argument and the analysis of alternative incentivisation mechanisms in light of behavioural law and economics. Das Immaterialgüterrecht wird auch in Deutschland zunehmend zum Objekt ökonomischer Analyse des Rechts. Der Beitrag untersucht Möglichkeiten und Grenzen ökonomischer Forschung im Urheberrecht. Dabei bezieht die Untersuchung neuere Ansätze der verhaltensökonomischen Verfeinerung ökonomischer Modelle durch psychologische Experimental- und Feldforschung zur Realwirkung rechtlicher Regelungen bewußt mit ein. In diesem weit gezeichneten Rahmen wird zuerst der Beitrag der ökonomischen Analyse zur grundsätzlichen Rechtfertigung und angemessenen Modellierung urheberrechtlichen Schutzes untersucht. Da in diesem Zusammenhang – auch angesichts fehlender empirischer Forschung – notwendig viele der »großen« Fragen offen bleiben, steht in der Folge die Suche nach methodischen und gesetzgebungstechnischen Rahmenbedingungen für das Wechselspiel von gesetzgeberischer Rechtsetzung und gerichtlicher Rechtsanwendung im Mittelpunkt. Idealerweise sollten es diese Rahmenbedingungen Gesetzgeber und Gerichten ermöglichen, in einem iterativen Erkenntnisfindungsprozeß unter Bedingungen der Unsicherheit angemessene Lösungen zu finden. Für den richtigen Zuschnitt der jeweiligen Rolle des Gesetzgebers und der Gerichte in diesem Erkenntnisfindungsprozeß kann wiederum (auch) die ökonomische Forschung wertvolle Hinweise geben. Zudem werden einzelne derzeit besonders lohnende Forschungsfelder für weiterführende theoretische und empirische ökonomische Untersuchungen identifiziert.
