Law enables citizens and states to cooperate. At the same time it determines the requisites for the creation of communities, such as the state, the European Union and the society of states. Therefore politics use law to create communities and to achieve certain objectives. But the law is unable to meet this claim implicitly: On the one hand it should confine politics and on the other hand it can be damaged, if the objectives of creation are not achieved. The Stability and Growth Pact of the European Union, for example, was not able to govern the budgetary policy of Germany and France the way it was intended to be. Thus the creation through law reached a limit, because the normative power of the regulations was not strong enough to keep politics in check. The law had to be adapted to the political will to meet the claims of a community based on law. Other examples are the EU financial aid to Greece and the European Financial Stability Facility. Both measures conflict with EU Law. Considerations do not play a role as they are perceived as being without alternatives. If the European Union as a whole is at stake, needs must when the devil drives. This warrants the question of a European emergency legislation, which is extremely disputable. Since the validity of law depends amongst others also on its public acceptance, an ultimate legal solution for a societal problem should be impossible. This does not mean that ultimate solutions should be abandoned. But the political community of citizens should realize their danger and should be cautious in terms of creation through law.
