Summary
With the 'major amendment to higher education law' the Brandenburgian legislature tries to deal with current higher education- and socio-political challenges, which has been successful in various areas. Regardless of this the universities' room for manoeuvre is not increased, but rather the impression of increased control is conveyed. Insofar as the topic of 'autonomy' is taken up by an important regulatory complex on the university management level and the university chancellor, the attempt to 'repair' a formerly unconstitutional regulatory finding with regard to the chancellor's office also fails, as the current version raises new constitutional issues that significantly call into question the constitutionality of the regulatory mechanism now chosen. On the other hand, the inclusion of the 'hard-won' regulatory mechanism in the amendment to the Higher Education Act is to be welcomed with regard to enabling the Brandenburg University of Technology Cottbus-Senftenberg to take a first important step towards becoming a 'university only', according to the wording of the Science Council. This will enable the university to successfully integrate the existing university of applied sciences departments into the university elements or to fuse them completely.
