Verfassungsrechtlicher Schutz der gemeindlichen Selbstverwaltung gegen Eingriffe durch Gesetz

Self-administration of local authorities is often described in terms of special autonomies, for example in finances, organisation or regulation. However, these competences don't mention only autonomies, but also matters of intervention of higher federal instances. It is necessary to fix these matters in order to know something about the intensity of judicial review. The border line between autonomy and intervention reveals to be the difference between pouvoir constitueé and constituant in relation to local authorities.
