Summary
Trust – in the honesty of others and in the good outcome of a matter – is the indispensable basis of living together in a community. In recent times, symptoms of eroding trust can be observed. The loss of trust is accompanied by phenomena of private and political self-empowerment. This gives rise to an investigation of the preconditions and contents of trust within the constitutional state. In private law, the contract is the essential basis of trust. In the relationship between state and citizen, a distinction can be made between trust based on the rule of law and democratic trust.
