Zur Konventionsauslegung und zum Begründungsstil des EGMR im Urteil KlimaSeniorinnen

The judgment of the Grand Chamber of the ECtHR in »Klimaseniorinnen« is unusual because of its extreme length, dynamic treaty interpretation and atypical style of reasoning. Many passages are preceded by general assessments and principles, apparently intended to legitimize the Court's self-assurance in the context of climate science and human rights, and are to prepare an innovative line of case law. Even if the result can be supported politically, the Court's methodological approach is largely unconvincing. This applies both to the findings of admissibility and to the statements on the merits.
