Summary
The impact of European law on the international private laws of the member states of the European Community is a very recent field of research. Johannes Fetsch examines the limitations set by the EC Treaty on the territorial scope of international mandatory rules. He develops a model of a horizontal order of jurisdiction among the member states, which serves as a blueprint for an intra-European conflict of laws system in the field of international mandatory rules. On this basis, the international courts have no discretion with respect to the application of foreign mandatory rules of other EC-Member States.
