In order to overcome difficulties of producing evidence, parties in cartel damages proceedings benefit from new instruments for obtaining information and facilitating evidence. While these instruments pursue the goal of ensuring effectiveness of antitrust provisions, they come into conflict with essential legal principles of civil and procedural law.
