Tatsachenbehauptung und Werturteil in der deutschen und französischen Presse

The classification of a comment as either a statement of fact or a value judgement is decisive in establishing the legitimacy of the comment in the German law for the protection and respect of a person's honor. However the delimitation of both types of statement is difficult, the results of the classification are hard to predict and on occasion scarcely comprehensible. Against this backdrop, Oliver Stegmann compares German and French law. He questions whether French law has a more dependable method for the delimitation of both types of statement than German law does. In addition he also asks if there are other methods in French law which decide upon the legitimacy of statements and if it would make sense to apply these to German law.
