Summary
In the present-day theory of constitutional and administrative law, the concept of the relationship between law, administration and the individual continues to be seen from a lawmaking standpoint. One of its dogmas is that the administration should regard a parliamentary law as applicable even if in doing so it has to bring about or accept a situation which is contrary to the constitution. In this work, Hans-Detlef Horn gives the reader a new analysis of this problem, surveying it on the basis of constitutional law as seen from the dogmatical and the theoretical angle and coordinates the dependence of administrative action on the law and the obligation of each administration to act in immediate accordance with individual fundamental rights.
